Welcome to sumudwear.com (the “Website”), operated by Sumud Inc., doing business as Sumud™ (“Sumud™,” “we,” “us,” or “our”). Sumud Inc. is incorporated in Canada, with a mailing address at 3230 Yonge Street #4156, Toronto, ON M4N 3P6, Canada.

By accessing this Website or purchasing products from Sumud™, you (“you,” “user,” or “customer”) agree to these Terms of Service (the “Terms”). These Terms form a legally binding agreement between you and Sumud Inc. If you do not agree, you may not use the Website or our Services.

1. Acceptance & Related Policies

Your use of the Website is subject to these Terms, as well as our Privacy Policy and Return & Exchange Policy, which are incorporated by reference. By using our Services, you confirm that you have read and agree to these policies.

2. Eligibility

You must be at least the age of majority in your jurisdiction, or have parental/guardian consent, to use this Website. You agree to use our Services only for lawful purposes and in compliance with all applicable laws.

3. Orders & Fulfillment

  • All Sumud™ products are custom-made on demand.

  • Orders are accepted only once dispatched and confirmed by email.

  • Production time: 2–7 business days

  • Shipping time: 3–4 days (USA), 5–15 days (international)

  • Tracking information will be provided once shipped.

  • Orders may arrive in multiple shipments.

  • We reserve the right to cancel or limit orders, especially in cases of suspected fraud or reseller activity.

4. Pricing & Payments

  • Prices are shown in the currency selected at checkout and may change without notice.

  • You are responsible for applicable taxes, shipping fees, and customs duties.

  • Accepted payment methods: major credit/debit cards and PayPal.

  • Payments are securely processed by third-party providers (e.g., Shopify Payments).

  • We do not store credit card details; all payment data is encrypted.

5. Shipping & Delivery

  • We ship worldwide using USPS, DHL, FedEx, and local carriers.

  • Delivery times are estimates only and not guaranteed.

  • You must provide accurate shipping information. Packages returned due to incorrect addresses or unclaimed delivery may incur reshipping fees.

  • Customs duties, import taxes, and delays due to customs clearance are your responsibility.

6. Returns & Refunds

Because our products are custom-made:

  • We do not accept returns for buyer’s remorse, incorrect size, or color preference.

  • Returns are accepted within 14 days only for unused, unworn items in resalable condition.

  • Return shipping is covered by us only if the item is defective or incorrect.

  • To request a return, email info@sumudwear.com with your order number and photos (if applicable).

  • Approved refunds are processed within 10 business days to your original payment method.

7. Exchanges

We do not offer direct exchanges. To change size or style, return your eligible item and place a new order.

8. Defective or Incorrect Items

  • Report defective or incorrect items within 7 days of delivery.

  • Claims must be submitted within 30 days.

  • We will replace or refund qualifying items at no cost to you.

9. EU Right of Withdrawal

If you are an EU customer, you may cancel your order within 14 days of delivery. Return shipping costs are your responsibility unless the product is defective. Refunds will be issued within 14 days of receiving the return.

10. Non-Returnable Situations

We cannot accept returns for:

  • Used, washed, or damaged items

  • Items returned after 14 days

  • Final sale or non-returnable items

  • Orders delivered within normal timeframes

  • Packages lost due to incorrect addresses

11. Intellectual Property

All content on the Website (logos, text, designs, images, and graphics) is the property of Sumud Inc. or its licensors. Sumud™ is a registered trademark in Canada, the EU, UK, USA, China, and other jurisdictions internationally.

Any unauthorized use, reproduction, distribution, or exploitation of our intellectual property is strictly prohibited and may result in civil and/or criminal liability. We actively monitor infringements and will pursue all available legal remedies, including injunctions, damages, and recovery of legal costs.

12. Prohibited Uses

You may not use the Website:

  • For unlawful purposes or to violate laws/regulations

  • To infringe intellectual property rights

  • To harass, abuse, or defame others

  • To submit false, misleading, or harmful content

  • To upload malware, spam, or scrape our Services

  • To circumvent security features

We may suspend or terminate access for violations.

For EU customers, processing of personal data is subject to GDPR compliance. By using our Services, you consent to data transfer, storage, and processing outside your country where permitted by law.

14. Force Majeure

We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including but not limited to: natural disasters, wars, strikes, pandemics, political unrest, internet outages, or government restrictions.

15. Third-Party Services & Tools

Our Services may include features or links to third-party tools, carriers, or payment processors. These are provided “as is” and “as available.” We are not responsible for third-party actions, content, or failures. Your use of third-party services is at your own risk and subject to their terms.

16. Feedback & User-Generated Content

If you submit reviews, suggestions, or other content (“Feedback”), you grant Sumud Inc. a worldwide, royalty-free, perpetual license to use, reproduce, and display such content for marketing or operational purposes.

You represent that you own or control the rights to any content you provide and that it does not infringe on third-party rights. We may remove unlawful or abusive content at our discretion.

17. Disclaimers

  • Products are provided “as is” without warranties beyond those required by law.

  • We do not guarantee uninterrupted Website access or error-free service.

  • Delivery estimates are not guarantees.

18. Limitation of Liability

To the fullest extent permitted by law, Sumud Inc. is not liable for:

  • Indirect, incidental, or consequential damages

  • Lost profits, revenue, or data

  • Business interruption or loss of goodwill

Our maximum liability is limited to the lesser of (a) the purchase price you paid for the product at issue, or (b) CAD $100.

19. Indemnification

You agree to indemnify and hold harmless Sumud Inc., its directors, employees, and affiliates against claims, damages, or expenses arising out of your misuse of our Website, products, or violation of these Terms.

20. Modifications

We may update or modify these Terms at any time by posting changes on this page. The “Last Updated” date will reflect the latest version. Continued use of the Website means you accept the revised Terms.

21. Governing Law & Dispute Resolution

These Terms are governed by the laws of Ontario, Canada. Disputes must first be attempted to be resolved by contacting us at info@sumudwear.com. If unresolved, disputes shall be brought in the courts of Toronto, Ontario, unless otherwise required by law.

You agree to waive any right to participate in class actions or jury trials.

22. Severability & Entire Agreement

If any provision is found invalid, the remaining provisions remain enforceable.
These Terms, together with our Privacy Policy and Return & Exchange Policy, constitute the entire agreement between you and Sumud Inc.
